Man accused of attempted murder deemed incompetent for trial

    BELFAST — A Belmont man accused of attempted murder has been found incompetent to stand trial, according to court documents filed April 17.

    Jetton Whiting, 25, was arrested and charged with attempted murder, elevated aggravated assault with a dangerous weapon, and violating conditions of release as a result of the Jan. 4 attack.

    Whiting is accused of stabbing a 64-year-old homeowner multiple times after the man invited him to stay in his home due to inclement weather. Whiting was otherwise sleeping in a camper at the time.

    It was when the man requested he change his clothes due to personal body odor that Whiting reportedly attacked him with a knife.

    The victim was discovered lying in his bed bleeding the following day and was transported to Waldo County General Hospital for treatment of his injuries. Whiting was found hiding the day after the attack.

    Whiting was ordered by the court to undergo a Competency to Stand Trial Evaluation with Dr. Andrew Wisch, the State Forensic Evaluator. A competency hearing scheduled for April 17 where it was determined that Whiting is not competent to stand trial.

    The finding further specifies that Whiting be committed to the custody of the Commissioner of Health and Human Services (DHHS) for placement “in an appropriate program for observation, care, and treatment of people with mental illness or persons with intellectual disabilities or autism.”

    There are a number of places Whiting could be held while receiving treatment, ranging from an institution for the care and treatment of people with mental illness to a crisis stabilization unit or intermediate care facility. Any facility will have to be approved by the Court.

    According to the finding, reports will be sent regarding Whiting’s competence within 30 days, and if he is recommitted reports will also be sent at 60 days and 180 days. The reports will be forwarded to DHHS Commissioner Ricker Hamilton for review.

    The case against him has been continued until “the defendant is deemed by the court to be competent to stand trial,” according to the official finding.
