BELFAST — The two brothers involved in the daytime theft of medical marijuana plants in Winterport, while impersonating law enforcement officers, were sentenced to prison last month.

Jeffrey Hurd, 48, of Glenburn, and his brother, Kerry L. Hurd, 45, of Bucksport, had been indicted by a Waldo County grand jury in November 2014 for robbery, impersonating a public servant, theft and criminal trespassing, stemming from the Sept. 21, 2014 incident.

The robbery was caught on surveillance camera, and Jeffrey Hurd and a third man, later identified as Scott Roberts, 35, of Glenburn, were clearly visible. Kerry Hurd's face was only partially visible on the video.

More than three dozen tips from the public came after the photos of the men's faces were circulated and published by the media statewide.

Jeffrey Hurd and Roberts turned themselves into police Oct. 1, after learning they had been identified and warrants had been issued for their arrest. Police then confirmed the identity of the third man as Kerry Hurd and issue a warrant. Hurd was arrested Dec. 11 in the parking lot of a grocery store in Bucksport.

In a plea agreement, Jeffrey Hurd was sentenced to five years in prison with all but nine months suspended, two years of probation and $1,000 restitution.

Kerry Hurd was sentenced to three years in prison with all but nine months suspended. He was also sentenced to two years of probation and ordered to pay $1,000 restitution. For Kerry Hurd, the robbery and theft charges were dismissed as part of the plea agreement.

Roberts was sentenced to four years in prison with all but 15 months suspended, two years of probation and $1,000 restitution. In addition to the above charges, Roberts had been charged with tampering with a witness, victim or informant the day of the robbery.

The robbery and theft charged against Roberts were also dismissed as part of the plea agreement. All three men were sentenced in Waldo County Superior Court in February.

A fourth person was charged in the crime, accused of allegedly driving the three men to the property in Winterport. April Jones, 28, of Orneville Township, was identified as Roberts’ girlfriend. She was also arrested and charged with robbery and theft, but the status of her case is not yet known.
